RECORDS

Please provide records and cover letters at least 2 weeks prior to the scheduled evaluation.

Pursuant to the Labor Code §4062.3, all records that are to be reviewed must include an Attestation by the sending party with the correct and total amount of pages provided and signed under penalty of perjury. Please be advised, if an attestation is not received with the records, then the records will not be reviewed until the required Attestation is received. See CCR 9793(n) for the definition of “record review.”  

If a statement under penalty of perjury that the party has complied with Labor Code § 4062.3 is not included, the doctor cannot review the records.  Additionally, if the attestation as to the number of records being sent is not included or not correct, the doctor cannot review the records.  If one party sends records with the proper statement under penalty of perjury relating to compliance with 4062.3 and an attestation as to the number of pages sent, the doctor can review the records attached to that cover letter.  However, the doctor cannot review any records attached to the other cover letter until it is sent with the proper statement under penalty of perjury and attestation noted above.  As a result, if the cover letters don’t contain the penalty of perjury statement and attestation as to the number of pages, the doctor will do the evaluation and provide you with the history and findings on examination and issue the report.  When the proper cover letters come in with the records, the doctor will then review the records and issue a supplemental report and incorporate the original findings with the records and issue a detailed final conclusion.

Please note that the cover letters should provide an accurate list of the documents and records being sent and an accurate page count, which includes all documents sent, including advocacy letters, medical record index, and all of the records sent for review.  Please note oftentimes more records are sent than reflected in cover letters or less records are sent.  The doctor’s report will also provide a page count, which could reflect a different number.  The difference in the numbers of pages by senders versus the number of pages by the doctor could result from miscounts, or additional records sent not included in the record index or fewer records sent than are listed in the medical index.

QME/AME CANCELLATION/RESCHEDULE POLICY

Reschedules and/or Cancellations need to be made no less than 6 business days in advance in order to avoid any fees. Insufficient cancellations and no shows will be assessed $503.75 pursuant to the Official Medical-Legal Fee Schedule. If records are reviewed and a record review report is issued within 30 days of the scheduled date of the appointment, the doctor will charge the Medical Fee Schedule rate for review of the records in addition to the missed appointment or late cancellation fees.

DEPOSITIONS

The total fee for deposition is $1137.50 which includes 1 hours prep, 1 hour for the deposition, and 30 minutes for depo transcript review billed per the official medical fee schedule at $455/hour. Of note, the fee schedule requires a minimum to be paid and states the deposition fee must be received prior to the deposition. Any payments no received the morning of a deposition are subject to reschedules.

Please make checks payable to Expedient Medicolegal Services and indicate the name of the doctor, applicant, and date/time of the deposition. Our office requires a scanned copy of the check and proof of mailing prior to proceeding with a deposition if not received in advance. [

Per the regulations, any disposition canceled or re scheduled less than 8 calendar days is subject to a late cancel fee. In addition, no shows and failed depositions are also subject to the same fee.

LOCATIONS AND PARKING FEES

Some locations may require parking fees which vary depending on the location. The fees can range from $5 – $30 and are not in the company’s control. It is recommended applicants and interpreters plan in advance and allow enough travel and parking time. Our office does not validate parking as it is dependent on the various facilities being utilized.

QME/AME REPOINTMENT DURATION

Please plan to arrive at least 15 minutes prior to the scheduled evaluation start time. The duration of the evaluation depends on the complexity and specialty of the case and if an interpreter is required. Psychiatric and Psychological evaluations usually take anywhere from 4 to 8 hours from start to finish. Non-mental health evaluations will range from 30 minutes to 2 hours. Please bring a photo ID and a current list of your medication prescribed.

REMOTE HEALTH EVALUATIONS

For remote health evaluations, you will receive an email specific to your scheduled evaluator with a link for their preferred method of video call. Please be sure to download, if necessary, and test the audio and video prior to the date of the evaluation. If you have not received the email with the link, please contact our office at scheduling@expedientmedicolegal.com and include your first and last name, date of evaluation, and name of the physician scheduled to perform the evaluation.

Please log on at least 15 minutes prior to your scheduled evaluation start time.

Please make sure you are in a quiet and private location with no one around that is free from distractions for the entirety of your remote health evaluation.

Please do not plan to do a remote health evaluation in any public setting or motor vehicle.
